2. Declarations of Interest

3. Public Participation

4. Minutes of previous meeting
The minutes of the meeting held on 1st April were reviewed and signed as a correct record.
5. Matters arising:
Gatcombe Farm response to CMS Bath Ltd, following their presentation at the previous meeting. It was noted that, in order for the proposed development to take place, NSC would have to ask for an exception to the Local Development Plan, and this would have to be put before the Government Office. There appears to be some doubt about the status of the land whether it is B1/B2 use or not.
It was felt that the proposed development could be potentially a positive development for the village as a whole, in terms of the quality and nature of the development. It was suggested that CMS Bath Ltd should be asked to return to the Parish Council to discuss some issues, such as recovering the allotments that were on the site in years past. Cllr Matthews felt that a Section 106 contribution would be appropriate.
It was agreed to respond to CMS Bath Ltd along the lines discussed.
6. NSC South Area Planning Committee
The following items were noted:
* Silveridge, Bridgwater Road change of use appeal submitted
* Lulscott, Lulsgate Bottom use of land for parking of vehicles: appeal dismissed, further enforcement action being investigated.
* Gatcombe Farm parking of vehicles: compliance with Enforcement Notice required by 18th May
7. Decisions Notices issued by NSC
These were reviewed as follows:
* 08/P0275/F Box Bush Farm (Alvis Bros Ltd): planning permission refused on the grounds that the location, prominence, bulk, design and height of the proposed development and the loss of landscape planting would adversely affect the rural character of the area, contrary to Policy GDP/3 and RD/1 of the North Somerset Local Plan.
* 08/P/0272/F Tumbling Weir: replacement fence (retrospective) refused, due to the scale, design and location in the open countryside adversely affect the character of the landscape, contrary to Policy GDP/3 of the North Somerset Replacement Local Plan.
* 05/P/0572/LUE Certificate of Lawful Use refused, due to the evidence of continuous use being insufficient. It was noted however that there appeared to be a contradiction in the paperwork issued by the planning authority, to the effect that the use is lawful. It was felt that NSC should be asked for clarification of why the Parish Council’s comments in support of the application were not taken into account. It was agreed to approach the applicants to see if a discussion of their options would be helpful.
* 08/P/0419/F 4 Tincknells Row, Station Road replacement windows and door. This has been deemed as permitted development by NSC. Although Article 4 direction has been applied to the Wrington Conservation Area that removes permitted development rights for works to enlarge, alter or improve dwelling house windows, the area covered does not include the address in question. The Chairman read out his correspondence with the planning officer concerned, to the effect that this was not felt to be a correct interpretation of the regulations.

8. Planning Applications
08/P/0758/F Oakdene Farm, Cox’s Green change of use of redundant milking parlour to holiday accommodation: it was generally felt that the proposed development was an improvement on the existing situation. It was agreed to make no objection to the proposal, but to comment that the area of hard standing might be improved alongside the landscaping proposed, and that a condition should be added that, should the site be sold, no more than the minimum parking should be allowed in relation to BIA.
08/P/0789/EIA Bristol International Airport EIA Screening Opinion for the erection of a two storey walkway between terminal building and western apron. The Chairman explained that Environmental Impact Assessment is an EU requirement for major developments. The issue is not particularly relevant to the question of whether or not the walkway is permitted development. A copy of the submission made by the Parish Councils Airport Association had been received and it was felt that some of the comments made were useful. It was agreed that the Parish Council should press for an EIA. Cllr Glynn agreed to draft the wording of this and circulate for comment.
9. Other Planning Issues
a. Cllr Dunn Morua raised the issue of Piercehay, Bullhouse Lane (05/P/0603/F refers), in particular whether the conditions placed on the permission were observed in relation to bat roosts. It was agreed to refer the matter to the Enforcement section at NSC to investigate.
b. The Clerk reported that a number of residents had commented about items being stored on farmland at Mill Lane - further investigation had identified about a dozen large metal ‘containers’ in a field to the west of Mill Lane. It is understood that these are moved to and from building sites. This was a concern in terms of change of use and also the vehicle access, with a 3T limit on the road. It was agreed that the matter should be referred to the Enforcement section at NSC to investigate.
